Intro

These Terms and Conditions outline the rules and regulations for the use of the Manawahe Directory platform, located at https://manawahe.co.nz and its connected services. By accessing or using our platform, you accept these terms and conditions in full. Do not continue to use Manawahe Directory if you do not agree to all of the terms and conditions stated on this page.

Definitions

Listings: Ownership & Accuracy

  • Accuracy: All business information, details, contact media, and directory submissions provided to Manawahe Directory must be truthful, accurate, and kept up to date.

  • Ownership & Authorisation: By submitting a business listing or content, you affirm that you own the intellectual property or possess full authorisation to publish that content.

  • Prohibited Submissions: Submissions must not contain defamatory, offensive, misleading, or illegal material, and must comply with all applicable New Zealand laws.

  • Moderation Rights: We reserve the right to audit, modify, or permanently remove any user content or listing from the directory at our sole discretion without prior notice.

Listings: Locality & Pricing

  • Locality Intent: The Manawahe Directory is designed to connect users with authentic local businesses and services. You must provide accurate, up-to-date information regarding your physical location, operational base, or primary service area.
  • Non-Local Listings: Businesses or service providers operating outside the local area may be subject to non-local listing fees or premium subscription plans. Pricing and eligibility criteria for non-local entries will be clearly presented during the listing process.
  • Accurate Location Data: You are strictly prohibited from using false, misleading, or deceptive location details (including virtual addresses, PO Boxes presented as physical bases, or inaccurate service radiuses) to bypass locality restrictions or misrepresent your presence to users.
  • Right to Modify or Remove: We reserve the right to audit listings, request proof of local operation, reclassify non-local entries, or permanently remove any listing that deceives or misleads users, without refund.

Reviews and Ratings

  • Review Submission: Users may submit reviews for businesses listed on the Manawahe Directory. Reviews must reflect genuine personal experience, be accurate, truthful, and remain civil.
  • Moderation: We reserve the right (but assume no obligation) to review, edit, flag, or remove any customer reviews that breach our terms, contain hate speech, or appear to be fraudulent/spam.
  • Responsibility: Users remain legally responsible for the reviews they post. The Manawahe Directory does not endorse, verify, or take responsibility for user-submitted reviews. Licence to Reviews: By submitting a review, you grant Manawahe Directory a non-exclusive, royalty-free, perpetual licence to display, reproduce, and distribute the text across our platform and marketing channels.

Payment and Refund Policy

  • Subscription Fees: Premium listings, highlighted placement, and additional directory features may incur fees. All pricing will be explicitly detailed at the point of purchase.

  • Billing & Gateways: Payments are processed securely via Stripe. We accept major credit/debit cards and digital wallet payment methods. Available payment methods may change from time to time without prior notice.

  • Refunds: Refund requests are assessed at our sole discretion within 30 days of initial purchase if a paid service fails to deliver as specified.

Third-Party Links & Advertising

  • External Links: Listings and directory pages may link to third-party external websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.
  • Sponsored Listings: Advertisers and business owners are responsible for ensuring their ad content complies with relevant advertising standards. Sponsored or paid listings will be clearly indicated to distinguish them from standard directory entries.

Prohibited Activities

You are strictly prohibited from:

  • Automated data scraping, harvesting, or bulk copying of directory listings.

  • Using the platform to send unsolicited marketing (spam) to listed businesses.

  • Impersonating another person, business, or entity.

  • Interfering with or disrupting the infrastructure or security of manawahe.co.nz.

Violations may result in immediate suspension or permanent termination of access.

Disclaimer of Warranties

The platform and all directory content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not guarantee that the directory will be error-free, uninterrupted, or that the listed business details are accurate or up-to-date at all times.

Indemnification

You agree to indemnify, defend, and hold harmless MO Web Group Limited, its officers, directors, and employees from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the platform, your violation of these terms, or your infringement of any third-party rights.

Limitation of Liability

To the maximum extent permitted by New Zealand law, MO Web Group Limited shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from your access to or use of (or inability to access or use) the platform. Our aggregate liability shall not exceed the total amount paid by you, if any, for using paid platform services.

Intellectual Property Rights

Unless otherwise stated, MO Web Group Limited owns the intellectual property rights for the platform design, code, logos, and aggregated database structure. All rights are reserved. You may access content for personal, non-commercial use, subject to restrictions outlined in these terms.

Governing Law & Dispute Resolution
